MODIFICATION OF CHILD SUPPORT/MAINTENANCE (ALIMONY)
Divorce and paternity customers needing to modify their court
orders may avail themselves of the Pro-Se paperwork available in the Court
Trustees office, room 406, or the Hearing Officer Office, room 335.
As a pro se party, you are representing yourself in a court hearing, and you
will need to complete all forms in the Pro-se packet. The packet includes a
Motion and Notice of Hearing, Domestic Relations Affidavit, Child Care Verification,
Employer Verification, Request and Service Instruction Form, and Return of
Service for certified mail. You must also include your paycheck stub (with
year to date totals), last year's income tax records. Obtain a court date/time
from the Hearing Officer's Office by calling (913) 715-3668 or (913) 715-3669.
All parties to the case and their attorneys of record must be served with this
paperwork. Instructions are included with the Pro-Se packets.
Generally, a court date/time may be obtained within 4 - 6 weeks.
Do you have to have an attorney with you? The choice is yours, but one is not
required.
What if you disagree with the decision? You have the right to request a rehearing
or appeal.
Cost: $26.00 cash/money order due at time of filing of paperwork (no
personal checks).

MOTION FOR MEDICAL & DENTAL REIMBURSEMENT
Divorce and paternity customers needing reimbursement of a
child's medical and/or dental bills (including orthodontics), may
avail themselves of the Pro-Se paperwork available in the Court Trustee office,
room 406, or Hearing Officer Office, room 335.
The Divorce Decree/Property Settlement Agreement or Paternity order must include
language regarding responsibility for these bills by either party. Absent the
inclusive language, it is assumed that the custodial parent is responsible
for the bills.
As a pro se party you are representing yourself in a court hearing and will
need to complete all forms in the pro se packet which include Motion and Notice
of Hearing, Request and service instruction form, Return of Service for certified
mail, a copy of the page(s) in your divorce decree/property settlement agreement
or paternity order which states that the party shall be responsible for the
medical/dental expenses, copies of the medical/dental bills which have been
paid, and a copy of a statement wherein a request was made in writing for payment
of these bills and the same has been refused. Obtain a court date/time from
the Hearing Officer's Office by calling (913) 715-3668 or
(913) 715-3669.

ENFORCEMENT OF PARENTING TIME ORDERS
The term "parenting time" is now to be the term describing
the time a parent spends with the child and refers both to the time spent
in primary residency and what was previously termed as parental visitation.
Divorce and paternity clients needing to enforce an existing parenting time
order may avail themselves of the Pro-Se paperwork available in the Court Trustee
Office, room 406, or Hearing Officer Office, room 335.
As a pro se party you are representing yourself in a court hearing. You will
need to complete all forms in the pro se packet. The packet includes a Motion
and Notice of Hearing, Request and Service instruction form and Return of service
for certified mail. To obtain a court date/time from the Hearing Officer’s
Office, please call (913) 715-3668 or (913) 715-3669.

or guideline visitation, or more specific instructions. Absent the inclusive

The term "visitation" will now generally only refer to
that time a non-parent is allowed to spend with a child.
(i.e. grandparents, aunts, uncles etc).
Non-parents needing to enforce an existing visitation order may avail themselves

Office, room 335.

BIRTH CERTIFICATE CHANGES
Parents (biological mother/father) desiring to amend a child's
birth certificate need to have in their possession a certified copy of live
birth registration from the Vital Statistics Department for the State of
Kansas. If you need to obtain the Birth Certificate please call (785) 296-1434.
Criteria for a change:
1) child under 18 years of age, and
2) both biological parents (mother and father)
must voluntarily want to amend the birth certificate.
Most common changes include:
Adding a biological father's name and amending the child's name to the father's
last name (note: this does not include changing a child's last name to
that of a step-parent. That is considered an adoption procedure and is
not handled by this office. Consult an attorney for an adoption procedure.)
Adding/deleting/correcting the first/middle/last name of the child.
Cost: No cost by the Court, but Vital Statistics usually has a fee. In Kansas
it is $24.00.

Note: Any change you make to your child's birth certificate must also be changed
on their social security card.
